Terms of Service

Thank you for choosing That Art Place for your creative experiences! These Terms of Service ("Terms") govern your use of our services, including but not limited to our Paint and Sip events, private events, art classes, and any other offerings provided by That Art Place. By booking any of our services, you agree to comply with and be bound by these Terms.

1. Booking and Reservations

1.1 Paint and Sip Events
All Paint and Sip events require advance booking. Reservations can be made through our website on our booking page. Payment for the event must be received in full at the time of booking to confirm your spot.

1.2 Private Events and Birthdays
Private events, including birthday parties, corporate events, and any other private bookings, require a signed agreement and a deposit of $200 to confirm the reservation. Full payment must be made at least 2 days before the event date.

1.3 Art Classes
Art class bookings must be made online on our booking page. Payments for art classes are due at the time of registration. If you miss a class, no refund will be issued. Art classes are booked on a term by term basis. Individuals who have booked any art class two weeks before the end of the term will receive an email link to rebook if you choose to continue. However, if you or your child has not re-enrolled by the cut of date, the spot will be advertised and made available to the public.

2. Payments

2.1 Payment Methods
We accept payments through Credit Cards, Debit Cards, Paypal & EFT. All payments must be made in full at the time of booking to secure your spot for Paint and Sip events and art classes. Private events and birthdays must pay a $200 deposit upfront, then proceed to pay the rest in full two days before the event.

2.2 Deposits for Private Events
For private events, a non-refundable deposit is required at the time of booking. The balance is due 2 days before the event.

2.3 Refund Policy
No refunds are available for cancellations made at least 2 weeks in advance of the event or class. Cancellations made less than 2 weeks in advance will not be refunded, but you may reschedule for a future event or class which can be subject to availability. In the event of a studio cancellation (e.g., due to unforeseen circumstances), a full refund or rescheduling option will be offered.

3. Event Conduct and Safety

3.1 Age Requirements
Paint and Sip events are typically designed for adults 18 and over, though we also offer family-friendly sessions where children are welcome such as private events, birthdays, art classes and family sessions. For private events or birthday parties, please confirm the age group and any special requirements with our team. We do not accommodate children under the age of 6 for any events hosted by That Art Place.

3.2 Alcohol Policy
For Paint and Sip events, alcohol may brought by guests, depending on the location and event type. Guests must be 18 and over to consume alcohol on the premise and may be subject to an ID check.Guests must adhere to the relevant alcohol consumption laws and are responsible for their own conduct during the event. We reserve the right to refuse service to individuals who appear intoxicated or disruptive.

3.3 Studio and Mobile Event Safety
Your safety is our priority. We provide all necessary materials for art activities and ensure that they meet safety standards. In case of a mobile event, we ensure the equipment and supplies are safely transported and set up at your venue. For mobile events, please inform us of any space or access requirements in advance.

4. Mobile Events

4.1 Travel Fees
For mobile private events, we require an upfront fee of $200 in travel fees. The travel fee will be communicated and added to your total at the time of booking.

4.2 Setup and Cleanup
For mobile events, our team will arrive 2 hours before the event to set up. We ask that you provide adequate space and access for our team to set up comfortably. We also request that the area be available for cleanup at the conclusion of the event.

5. Cancellations and Rescheduling

5.1 Cancellations by the Client
Clients may cancel or reschedule bookings up to 2 weeks in advance for a full refund (minus any processing fees). For cancellations within less than 2 weeks, no refund will be issued, but we will offer a rescheduling option based on availability.

5.2 Cancellations by That Art Place
In the event that That Art Place must cancel an event due to circumstances such as weather, illness, or other unforeseen reasons, a full refund or rescheduling option will be offered.

6. Intellectual Property

6.1 Ownership of Artwork
All artwork created during our events and classes remains the property of the participant. However, by attending or participating in any event, you grant That Art Place the right to use images and videos of your artwork for promotional purposes, including on our website and social media pages, unless otherwise requested.

6.2 Copyright and Reproduction
Participants may not reproduce or sell any artwork created during our events or classes for commercial purposes without obtaining prior written permission from That Art Place. However, feel free to post your artwork on social media and tag us @ThatArtPlace !

7. Health and Well-Being

7.1 Health Considerations
If you have any allergies, health concerns, or special requirements, please inform us prior to booking or arriving for the event. This includes food allergies, asthma, or sensitivities to specific materials used during art classes. We strive to accommodate everyone’s needs wherever possible.

7.2 Behavioral Expectations
All participants are expected to behave respectfully toward the staff and other attendees. Disruptive or inappropriate behavior may result in removal from the event without a refund.

8. Liability and Disclaimers

8.1 Limitation of Liability
While we take every care to ensure your safety, by attending or participating in an event, you agree to hold That Art Place harmless for any accidents, injuries, or damages that may occur during the event. Participants are responsible for their own safety during art activities.

8.2 Force Majeure
That Art Place will not be held liable for any delays, disruptions, or cancellations due to circumstances beyond our control, including but not limited to acts of nature, government restrictions, or unforeseen events.

9. Privacy and Data Protection

9.1 Personal Data
By booking our services, you consent to the collection and use of your personal data for purposes related to your booking, communication, and our marketing activities. We respect your privacy and ensure that your data is securely stored.

9.2 Marketing
By booking a session with us, you agree to receive marketing emails about upcoming events and offers. You can opt-out at any time by unsubscribing from our email list.

10. Amendments to Terms

That Art Place reserves the right to amend these Terms of Service at any time. Any changes will be posted on this page, with the effective date indicated at the top. It is your responsibility to review these Terms regularly.
